Section 1

(1) These Regulations may be cited as the Advice and Assistance (Financial Conditions) (Scotland) Regulations 1995 and shall come into force on 5th May 1995.

(2) In these Regulations, “ the Act ” means the Legal Aid (Scotland) Act 1986.

Section 2

These Regulations shall apply only in relation to any case where an application for advice and assistance is made on or after 5th May 1995.

Section 3

For the weekly sum of £153 specified in section 8(a) of the Act , there shall be substituted the weekly sum of £156.

Section 4

For the weekly sum of £63 specified in section 11(2)(a) of the Act , there shall be substituted the weekly sum of £64.

Section 5

The maximum amount of fees or outlays which a client shall be liable to pay under section 11(2) of the Act , where his disposable income falls within a range specified in the first column of the following table, shall be the amount specified in relation to that range in the second column:—

(1) Exceeding £64 but not exceeding £71 a week

(2) Exceeding £71 but not exceeding £78 a week

(3) Exceeding £78 but not exceeding £85 a week

(4) Exceeding £85 but not exceeding £92 a week

(5) Exceeding £92 but not exceeding £99 a week

(6) Exceeding £99 but not exceeding £106 a week

(7) Exceeding £106 but not exceeding £113 a week

(8) Exceeding £113 but not exceeding £120 a week

(9) Exceeding £120 but not exceeding £127 a week

(10) Exceeding £127 but not exceeding £134 a week

(11) Exceeding £134 but not exceeding £141 a week

(12) Exceeding £141 but not exceeding £148 a week

(13) Exceeding £148 but not exceeding £156 a week

Section 6

The Advice and Assistance (Financial Conditions) (Scotland) Regulations 1994 are hereby revoked.
