Section 1 Citation, commencement, extent and interpretation

(1) These Regulations may be cited as the Environmental Protection (Determination of Enforcing Authority Etc.) (Scotland) Amendment Regulations 1995, shall come into force on 10th November 1995 and shall extend to Scotland only.

(2) In these Regulations “the 1992 Regulations ” means the Environmental Protection (Determination of Enforcing Authority Etc) (Scotland) Regulations 1992 .

Section 2 Amendment of regulation 3 of the 1992 Regulations

In regulation 3 of the 1992 Regulations, after paragraph (1) there shall be inserted—

(1A) Where, in respect of any prescribed process, the enforcing authority is not determined by the provisions of paragraph (1) above, the enforcing authority for that process shall be the chief inspector.
