Section 1

This Order may be cited as the Criminal Justice Act 1988 (Confiscation Orders) Order 1995 and shall come into force on 1st January 1996.

Section 2

Part I of Schedule 4 to the Criminal Justice Act 1988 (offences in respect of which magistrates' courts may make confiscation orders) shall be amended by the addition to the offences there listed of the following offences —

(a) an offence under section 107(1), (2) or (3) of the Copyright, Designs and Patents Act 1988 ;

(b) an offence under section 198(1) or (2) of the Copyright, Designs and Patents Act 1988;

(c) an offence under section 92(1), (2) or (3) of the Trade Marks Act 1994 .

Section 3

Accordingly, the table of offences set out in Part I of Schedule 4 to the Criminal Justice Act 1988 is amended by the addition, at the end, of the following:

The amendments made by article 2 above do not apply in relation to offences committed before the day on which this Order comes into force.
