Section 1Citation and commencement

This Order may be cited as the Education (Transfer of Functions Relating to Grant-maintained Schools) Order 1996 and shall come into force on 23rd September 1996.

Section 2Transfer of functions relating to grant-maintained schools

The power of the Secretary of State under section 68(6) of the Education Act 1993 to consent to borrowing by grant-maintained schools, mentioned in section 17(2) of the Education Act 1993, shall be exercisable instead by the Funding Agency for Schools .
