Section 1Citation, commencement and interpretation

(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Oil and Chemical Pollution of Salmon and Migratory Trout) Order 1996 and shall come into force on 20th March 1996.

(2) In this Order—

“migratory trout” means fish of the species Salmo trutta L. ;

“relevant time” means one minute past midnight on 19th March 1996; and

“salmon” means fish of the species Salmo salar L.

Section 2Designated circumstances

In the opinion of the Secretary of State salmon and migratory trout in the areas designated in article 3 below may be affected by oil or other chemical substances which are likely to create a hazard to human health if they are consumed.

Section 3Designated area

The areas described in the Schedule to this Order are hereby designated for the purposes of Part I of the Food and Environment Protection Act 1985.

Section 4Activities prohibited in the designated areas

No person shall fish for and take any salmon or migratory trout in a designated area.

Section 5Prohibition on movement

No person shall move any salmon or migratory trout out of a designated area.

Section 6Restrictions throughout the United Kingdom

No person shall in the United Kingdom or in United Kingdom waters—

(a) use any salmon or migratory trout taken out of a designated area after the relevant time in the preparation or processing for supply of food and anything from which food could be derived,

(b) land any salmon or migratory trout which were in waters in a designated area after the relevant time,

(c) supply, or have in possession for supply, any salmon or migratory trout which were in a designated area after the relevant time,

(d) supply, or have in possession for supply, any food or anything from which food could be derived in the preparation or processing of which anything was used in contravention of paragraph (a) of this article,

(e) feed to any creature a feeding stuff in the preparation or processing of which anything was used in contravention of paragraph (a) of this article.
