Section 1Citation and commencement

This Order may be cited as the Local Government Reorganisation (Wales) (Staff) (No. 2) Order 1996 and shall come into force on 1st April 1996.

Section 2Interpretation

(1) In this Order—

“the 1994 Act ” means the Local Government (Wales) Act 1994;

“new authority” means a county or county borough council which is established under the 1994 Act or a National Park authority established by article 3 of the National Park Authorities (Wales) Order 1995 ;

“old authority” means a county or district council which ceases to exist as a result of the 1994 Act;

“the deposited list” has the same meaning as in the principal order ; and

“the principal order” means the Local Government Reorganisation (Wales) (Staff) Order 1996 .

(2) For the purposes of articles 4 and 5, a person is described in column 2 of the Schedule by reference to one or more of the following—

(a) his name,

(b) his employee number which is within brackets unless the context otherwise requires,

(c) the title or description of his post,

(d) the establishment at which or the geographical area within which he works.

Section 3Application

This order shall not apply to any person who is an employee of an old authority—

(a) whose contract of employment provides for the termination of that contract on 31st March 1996;

(b) who is dismissed with effect from 31st March 1996 (unless that person is later reinstated with effect from that date);

(c) who terminates his contract of employment as at 31st March 1996.

Section 4Amendment of the principal order

(1) Article 5 of the principal order shall not apply to any person described in column 2 of Part I or Part II of the Schedule to this Order who, immediately before 1st April 1996, was employed by the old authority specified in relation to that person in column 1 of Part I or Part II of the Schedule, as the case may be.

(2) In the Schedule to the principal order, in the list of numbered Parts of the desposited list to which reference is made in the section headed Category 2, under Part 7 (Gwynedd County Council), in column 1 there shall be deleted “(e)”, and in column 2 in the corresponding entry there shall be deleted“Anglesey County Council and Caernarfonshire and Merionethshire County Council”.

Section 5Designation of staff

(1) Subject to article 3, any person who, immediately before 1st April 1996, was employed by an old authority named in column 1 of Part II or Part III of the Schedule to this Order and who is described in column 2 of Part II or Part III of the Schedule, as the case may be, is hereby designated for the purposes of section 42 of the 1994 Act.

(2) In relation to any person designated under paragraph (1), the new authority named in column 3 of Part II or Part III of the Schedule, as the case may be, in relation to the person so designated shall be the specified new employer of that person for the purposes of section 42 of the 1994 Act.
