Section 1 Citation, commencement and interpretation

(1) This Order may by cited as the East Surrey and Sutton District Water (Amendment of Local Enactments Etc.) Order 1996 and shall come into force on 1st April 1996.

(2) In this Order—

“East Surrey” means East Surrey Water Plc; and

“Sutton” means The Sutton District Water Plc.

Section 2 Amendment of references in local statutory provisions etc.

(1) Any reference to Sutton, or to the undertaking of Sutton, in any local statutory provision and in any charges scheme made by Sutton under section 76 of the Water Act 1989 or section 143 of the Water Industry Act 1991 shall have effect, subject to paragraph (2), as a reference to East Surrey or, as the case may be, to the undertaking of East Surrey.

(2) Paragraph (1) shall only apply to any local statutory provisions or charges scheme in relation to the area, things or persons in relation to which or whom that provision or scheme has effect before 1st April 1996.

Section 3 Repeal of local provisions

Section 9 of the East Surrey Water Act 1921 is repealed.
