Section 1 Citation and interpretation

(1) This Order may be cited as the Flood Prevention and Land Drainage (Scotland) Act 1997 (Commencement) Order 1997.

(2) In this Order, “ the Act ” means the Flood Prevention and Land Drainage (Scotland) Act 1997.

Section 2 Commencement of Act

(1) Subject to paragraphs (2) and (3) below and to section 9(3) of the Act, the Act, so far as not already in force, shall come into force on 26th May 1997.

(2) Section 2 of the Act shall come into force on force on 28th July 1997.

(3) The following provisions of the Act shall come into force on 1st April 1999:–

(a) the Schedule, so far as it repeals–

(i) provisions in the Land Drainage (Scotland) Act 1930 ; and

(ii) the Land Drainage (Scotland) Act 1941 ; and

(b) section 8, so far as it relates to the provisions specified in sub-paragraph (a) above.
