Section 1 Citation, commencement and interpretation

(1) This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) (Amendment) Order 1997 and shall come into force on 14th August 1997.

(2) In this Order,

“the 1994 Order ” means the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1994 .

Section 2 Amendment to the 1994 Order

For article 4(1) of the 1994 Order (defined activity exemption conditions) substitute the following—

(1) Subject to paragraphs (4) and (5), during the period beginning with 1st April 1994 and ending on,

(a) 31st March 1999, in relation to an activity mentioned in section 2(2)(a), (c), (f) or (g) of the Act; and

(b) 31st May 1999, in relation to an activity mentioned in section 2(2)(b), (d), (e) or (ee) of the Act ,

such an activity shall not be treated as a defined activity if carried out during the period relating to that activity by a defined authority to which this Order applies, so long as any one of the conditions specified in paragraph (2) is fulfilled.
