Section 1Citation and commencement
This Order may be cited as the Education (Transfer of Functions Relating to Grant-maintained Schools) Order 1997, and shall come into force on 5th March 1997.

Section 2Revocation
The Education (Transfer of Functions Relating to Grant-maintained Schools) Order 1996 is hereby revoked.
Section 3Transfer of functions relating to grant-maintained schools
The power of the Secretary of State under section 231(6) of the Education Act 1996 to consent to borrowing by grant-maintained schools, mentioned in paragraph 1(2) of Schedule 3 to that Act, shall be exercisable instead, in relation to England, by the Funding Agency for Schools .
