Section 1 Citation and commencement

This Order may be cited as the Local Government Act 1988 (Exemption for Works Contracts) (Scotland) Order 1998 and shall come into force on 30th June 1998.

Section 2 Exemption for works contracts

(1) The provision of services specified in paragraph (2) below shall not be treated as a defined activity so long as it is carried out in pursuance of a works contract by a local authority (within the meaning of section 1(3) of the Local Government Act 1988 ) before 1st April 2001.

(2) The services specified in this paragraph are–

(a) housing management;

(b) management of vehicles;

(c) security work;

(d) legal services;

(e) construction and property services;

(f) financial services;

(g) information technology services;

(h) personnel services.
