Section 1 Citation and commencement

These Regulations may be cited as the Social Security (Guardian’s Allowances) Amendment Regulations 1998 and shall come into force on 31st August 1998.

Section 2 Amendment of the Social Security (Guardian’s Allowances) Regulations 1975

In regulation 4(1) of the Social Security (Guardian’s Allowances) Regulations 1975 (children of divorced persons, etc. ) for the words from “there was no order” to “of the Act” the following words shall be substituted—

there was neither—

an order of a court granting custody of the child to that other parent or imposing any liability on him for the child’s maintenance; nor

a maintenance assessment as defined in section 54 of the Child Support Act 1991 in force in respect of that other parent and the child,then section 77(2) of the Social Security Contributions and Benefits Act 1992
