Section 1 Title and commencement

These Regulations may be cited as the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1998 and shall come into force on 16th February 1998.

Section 2 Amendments to the Hill Livestock (Compensatory Allowances) Regulations 1996

(1) The Hill Livestock (Compensatory Allowances) Regulations 1996 shall be amended in accordance with the following paragraphs of this regulation.

(2) In paragraph (1) of regulation 2 (interpretation)—

(a) the definitions of “the 1995 Order” and “the 1984 Regulations” shall be revoked;

(b) the following definition shall be inserted immediately after the definition of “the 1994 Regulations”—

“the 1997 Regulations ” means the Cattle Identification (Enforcement) Regulations 1997 ;

(c) in the definition of “the 1993 Suckler Cow Regulations” there shall be inserted at the end “, as amended at the time the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1998 are made”.

(3) In paragraph (3) of regulation 2 there shall be substituted for “the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1997” the following—

the Hill Livestock (Compensatory Allowances) (Amendment) Regulations 1998

(4) In paragraph (1A) of regulation 3 (compensatory allowances for breeding cows and ewes)—

(a) there shall be substituted for “the 1997 Scheme year” the phrase “the 1998 Scheme year”;

(b) in sub-paragraphs (a) and (b)(i), for “£97.50” there shall be substituted “£47.50”;

(c) in sub-paragraph (b)(i), for “£121.49” there shall be substituted “£88.70”; and

(d) in sub-paragraphs (b)(ii) and (c), for “£69.75” there shall be substituted “£23.75”.

(5) In paragraph (1B) of regulation 3—

(a) there shall be substituted for “the 1997 Scheme year” the phrase “the 1998 Scheme year”; and

(b) in sub-paragraph (b)(ii)(aa), for “£121.49” there shall be substituted “£88.70”.

(6) In paragraph (2) of regulation 3, for “, the 1992 Regulations or the 1984 Regulations” there shall be substituted “or the 1992 Regulations”.

(7) In paragraph (3) of regulation 3, the phrase “Subject to paragraph (3A)” shall be revoked.

(8) Paragraph (3A) of regulation 3 shall be revoked.

(9) In paragraph (5)(a) of regulation 9 (powers of authorised persons)—

(a) the phrase “the 1995 Order or” shall be revoked; and

(b) there shall be inserted after the phrase “the 1996 Order” the phrase “or the 1997 Regulations”.

(10) In paragraph (4) of regulation 12 (withholding or recovery of compensatory allowance), for “article 5 of the 1995 Order” there shall be substituted “regulation 3(3) and (4) of the 1997 Regulations”.
