These Regulations may be cited as the Legal Aid in Criminal and Care Proceedings (Costs) (Amendment) (No. 4) Regulations 1998 and shall come into force on 11th January 1999.

The Legal Aid in Criminal and Care Proceedings (Costs) (Amendment) (No. 4) Regulations 1998
In these Regulations “ the Regulations ” means the Legal Aid in Criminal and Care Proceedings (Costs) Regulations 1989 and a reference to a regulation or Schedule by number alone means the regulation or Schedule so numbered in the Regulations.
In regulation 4E the following shall be substituted for the words from “the franchisee may apply” to “a claim for costs”: “the Board may make interim payments”.
After regulation 6(7) the following paragraph shall be inserted:
(8) Where legal aid is provided under a franchising contract, this regulation shall apply except to the extent that the contract makes different express provision.
In regulation 7A(2) after “Schedule I Part I” there shall be inserted: “except to the extent that a franchising contract makes a different express provision”.
After regulation 10(2) the following paragraph shall be inserted:
(3) Where legal aid is provided under a franchising contract, this regulation shall apply except to the extent that the contract makes different express provision.
