Section 1 Citation, commencement and interpretation

(1) This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (No. 1) Order 1998 and shall come into force on 1st April 1998.

(2) In this Order

“the 1988 Act ” means the Local Government Act 1988.

Section 2 Exemptions

An activity specified in any of paragraphs (a) to (n) of subsection 2 of section 2 (defined activities) of the 1988 Act shall not be treated as a defined activity so long as it is carried out by a defined authority listed in the Schedule to this Order during the period beginning with 1st April 1998 and ending on 31st March 2001.

Section 3 Revocations

(1) All directions given by the Secretary of State under section 14(2) and (3) (power to give directions) of the 1988 Act to any of the authorities mentioned in article 2 above are hereby revoked.

(2) In the Local Government Act 1988 (Defined Activities) (Exemption) (London Boroughs of Newham and Southwark) Order 1997 , article 2 (exemption of sports and leisure facilities management) is hereby revoked.

(3) The Local Government Act 1988 (Defined Activities) (Exemption) (London Borough of Brent) Order 1997 is hereby revoked.

(4) In the Local Government Act 1988 (Defined Activities) (Exemption) (Brent London Borough Council and Harrogate Borough Council) Order 1997 , article 2 (exemption of grounds maintenance) is hereby revoked.
