Section 1Citation and commencement

This Order may be cited as the Contracting Out (Jury Summoning Functions) Order 1999 and shall come into force on 31st August 1999.

Section 2Interpretation

In this Order,:

“ the Act ” means the Juries Act 1974 ;

“contracted-out function” means any function which is the subject of an authorisation given in accordance with article 3(1) of this Order and “authorised contractor” means the person to whom, and to whose employees, that authorisation is given;

“relevant functions” means

the functions of the Lord Chancellor under section 2 of the Act , in so far as those functions involve the production and posting of jury summonses; and

the signing of certificates of posting under section 2(6) of the Act.

Section 3Contracting out of functions

(1) Any or all of the relevant functions may be exercised by, or by employees of, such person as may be authorised in that behalf by the Lord Chancellor.

(2) In relation to any contracted-out function, the expression “the appropriate officer” in section 2 of the Act shall be construed as if it referred to such employee of the authorised contractor as may be designated for the purpose of that function by the authorised contractor.
