The Education Act 1996 (Modification of Section 517) Regulations 1999

Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Education Act 1996 (Modification of Section 517) Regulations 1999 and shall come into force on 1st September 1999.

(2) In these Regulations “the relevant period” means the period starting on 1st September 1999 and ending on the day when the repeal of section 517 of Education Act 1996 effected by Schedule 31 to the School Standards and Framework Act 1998 comes into force (and accordingly if different days are appointed for the coming into force of the repeal of that section in relation to England and in relation to Wales the relevant period in relation to England shall be different from that in relation to Wales).

Section 2 Modification of section 517 of the Education Act 1996

(1) During the relevant period section 517 of the Education Act 1996 shall have effect as if–

(a) in subsection (1) for “which is neither a maintained nor a grant-maintained school” there were substituted “which is not a school maintained by a local education authority”;

(b) in subsection (3)–

(i) for “every maintained or grant-maintained school” there were substituted “every school maintained by a local education authority” and

(ii) for “which is neither a maintained nor a grant-maintained school” there were substituted “which is not maintained by a local education authority”; and

(c) in subsection (7) (as inserted by subsection (6)(e)) the words “In this section “grant-maintained school” includes a grant-maintained special school, and” were omitted.
