Section 1 Citation, commencement and interpretation

(1) This Order may be cited as the St. Helens and Knowsley Hospital Services National Health Service Trust (Establishment) Amendment Order 1999 and shall come into force on 22nd March 1999.

(2) In this Order, “the Establishment Order ” means the St. Helens and Knowsley Hospital Services National Health Service Trust (Establishment) Order 1990 .

Section 2 Amendment of NHS trust Establishment Order

(1) In article 1(2) of the Establishment Order (interpretation), the following definition shall be inserted:–

“community health services” means any services which the Secretary of State may provide under section 3(1)(d) or (e) of or Schedule 1 to the National Health Service Act 1977 and any service which he has a duty to provide under section 5(1) or (1A) of that Act

(2) For article 3 of the Establishment Order (functions of the trust) there shall be substituted the following:–

Nature and functions of the Trust

(1) The trust is established for the purposes specified in section 5(1) of the Act.

(2) The trust’s functions shall be:–

(a) to own and manage pursuant to section 5(1)(a) of the Act the Whiston Hospital, Warrington Road, Whiston, Prescot L35 5DR and associated hospitals, establishments and facilities, and there to provide and manage hospital accommodation and services, and there and from there to provide and manage community health services; and

(b) to provide and manage pursuant to section 5(1)(b) of the Act Peasley Cross Unit, Marshalls Cross Road, St. Helens, Merseyside WA9 3DA, and there to provide and manage hospital accommodation and services.
