Section 1 Title and commencement

These Regulations may be cited as the Plant Health (Fees) (Forestry) (Great Britain) (Amendment) Regulations 1999 and shall come into force on 6th April 1999.

Section 2 Amendment of the Plant Health (Fees) (Forestry) (Great Britain) Regulations 1996

(1) The Plant Health (Fees) (Forestry) (Great Britain) Regulations 1996 shall be amended in accordance with the following provisions of this regulation.

(2) In regulation 1 (title, commencement, extent and interpretation), in paragraph (3) –

(a) after the definition of “authority” there shall be inserted –

“Class A specified wood” means wood described in column 2 (description of relevant material) of items 1, 4 to 10 and 23 to 29 in Part A of Schedule 4 to the Order

“Class B specified wood” means wood described in column 2 (description of relevant material) of items 2, 2A and 3 in Part A of Schedule 4 to the Order;

(b) for the definition of “relevant corresponding conditions” there shall be substituted –

“relevant corresponding conditions”, in relation to any Class A specified wood, Class B specified wood or specified isolated bark, means the conditions specified in column 3 (conditions of landing) and column 4 (certification) of Part A of Schedule 4 to the Order (material consigned directly from third countries whose landing in Great Britain is subject to special conditions) which correspond to that Class A specified wood, Class B specified wood or specified isolated bark;

(c) for the definition of “specified wood or isolated bark” there shall be substituted –

“specified isolated bark” means isolated bark described in column 2 (description of relevant material) of items 20 to 22 in Part A of Schedule 4 to the Order;

(3) For Schedule 3 there shall be substituted the provisions of the Schedule to these Regulations.
