Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Transport and Works (Assessment of Environmental Effects) Regulations 2000 and shall come into force on 1st January 2001.

(2) In these Regulations—

“ the Act ” means the Transport and Works Act 1992 ;

“ the Rules ” means the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 2000 .

Section 2 Amendment of the Transport and Works Act 1992

In section 6A of the Act after subsection (2) there shall be inserted—

(3) “Member State” includes a state which is a contracting party to the Agreement on the European Economic Area signed at Oporto on 2nd May 1992, as adjusted by the Protocol signed at Brussels on 17th March 1993

Section 3 Amendment of the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 2000

In rule 4 of the Rules after the definition of “local planning authority” there shall be inserted—

“Member State” includes a state which is a contracting party to the Agreement on the European Economic Area signed in Oporto on 2nd May 1992 as adjusted by the Protocol signed at Brussels on 17th March 1993
