Section 1 Citation and commencement

These Regulations may be cited as the Legal Aid in Criminal and Care Proceedings (Costs) (Amendment No. 2) Regulations 2001 and shall come into force on 15th November 2001.

Section 2 Amendments to the Legal Aid in Criminal and Care Proceedings (Costs) Regulations 1989

(1) Part III of Schedule 1 to the Legal Aid in Criminal and Care Proceedings (Costs) Regulations 1989 shall be amended as follows.

(2) For paragraph 6(a) there shall be substituted—

(a) travelling and waiting time of fee-earners and unassigned counsel, which shall be payable at the rate provided in paragraph 1(1)(a) (or paragraph 1A or 1AA as the case may require) of Schedule 1 Part I; and

(3) For paragraph 7(3) there shall be substituted—

(3) The rates specified in paragraph 1(1)(a) (or paragraph 1A or 1AA as the case may require) of Schedule 1 Part I shall apply to the costs claimed, subject to the provisions of paragraph 2 of that Part of that Schedule.
