Section 1 Citation, commencement and extent

(1) This Order may be cited as the Education (Special Educational Needs Code of Practice) (Appointed Day) (England) Order 2001 and shall come into force on 1st January 2002.

(2) This Order applies in relation to England.

Section 2 Interpretation

In these Regulations—

“the Appointed Day ” means 1st January 2002;

“the 1994 Order ” means the Education (Special Educational Needs Code of Practice) (Appointed Day) Order 1994 .

Section 3 Appointed Day

The Special Educational Needs Code of Practice issued pursuant to section 314(4) of the Education Act 1996 on 3rd December 2001 shall come into effect on the Appointed Day.

Section 4 Consequential and revocation

(1) The Code of Practice on the Identification and Assessment of Special Educational Needs issued pursuant to the 1994 Order shall cease to have effect in so far as it relates to England on the Appointed Day.

(2) The 1994 Order is hereby revoked in so far as it relates to England.
