The Education (School Teachers' Pay and Conditions) Order 2002

Section 1Citation, commencement and revocation

This Order may be cited as the Education (School Teachers' Pay and Conditions) Order 2002 and shall come into force on 1st April 2002.

Section 2Application

This Order applies to school teachers (as defined in section 5(1) and (2) of the Act ) in England and Wales.

Section 3School Teachers' Pay and Conditions

The School Teachers' Pay and Conditions Document 2001 shall be amended with effect from 1st April 2002 as follows:

(a) in paragraph 3.3(b) for “19” there shall be substituted “15” and for “18” there shall be substituted “16”;

(b) in paragraph 4.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(c) in paragraph 4.2 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(d) in paragraph 4.3 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(e) the following table shall be substituted for the table in paragraph 4.5—

(f) the following table shall be substituted for the table in paragraph 6.3—

(g) in paragraph 7.3(b) for “8.2” there shall be substituted “7.2”;

(h) in paragraph 7.3(c) for “8.2” there shall be substituted “7.2”;

(i) in paragraph 15.2 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(j) the following table shall be substituted for the table in paragraph 15.3—

(k) in paragraph 17.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002” and for “17.3” there shall be substituted “17.5”;

(l) the following table shall be substituted for the table in paragraph 17.5—

(m) in paragraph 22.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(n) the following table shall be substituted for the table in paragraph 22.1—

Management Allowances

(p) in paragraph 23.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002” in both places;

(q) the following table shall be substituted for the table in paragraph 23.1—

Recruitment and retention allowances

(r) for paragraph 24.1 there shall be substituted the following—

(24.1) From 1st April 2002, the annual value of a first special educational needs allowance referred to in paragraph 24 is £1,626, and the annual value of a second special educational needs allowance referred to in paragraph 24 is £3,219.

(s) in paragraph 26.4 for “17.3” there shall be substituted “17.5”;

(t) in paragraph 27.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(u) the following table shall be substituted for the table in paragraph 27.1—

(v) in paragraph 29.2 for “29.11” there shall be substituted “29.10”;

(w) paragraph 29.11 shall be deleted;

(x) in paragraph 31.1 for the words “From 1st April 2001” there shall be substituted the words “From 1st April 2002”;

(y) the following table shall be substituted for the table in paragraph 31.1—

(z) for paragraph 36.1 there shall be substituted the following:

(36.1) A teacher serving in the London Area shall receive a London Area allowance of:

(a) if he is serving in the Inner London Area, £3,105 per annum from 1st April 2002;

(b) if he is serving in the Outer London Area, £2,043 per annum from 1st April 2002; and

(c) if he is serving in the Fringe Area, £792 per annum from 1st April 2002.

(aa) in paragraph 39.5(c) for “22” there shall be substituted “23”;

(bb) after paragraph 46A there shall be inserted the following paragraph:

General Teaching Councils' Fee Allowance

(46B.1) The relevant body in relation to a teacher liable to pay a fee in respect of their registration with the General Teaching Council for England or the General Teaching Council for Wales shall, in respect of the fee due in the year 1st April 2002 to 31st March 2003, determine that a single payment of £33 shall be paid to that teacher.

(46B.2) Before making a determination under paragraph 46B.1 the relevant body shall take reasonable steps to satisfy itself that the teacher has not received a payment under paragraph 46B.1 from any other relevant body.

(46B.3) A local education authority shall upon request take reasonable steps to provide a relevant body with information as to whether or not a teacher who is or has been employed at a school or as an unattached teacher within that authority has received a payment under paragraph 46B.1.

(46B.4) Paragraph 40 of this Document shall not apply to this allowance.

(cc) in paragraph 47.1 after “advanced skills teachers” there shall be inserted “and fast track teachers”.
