Section 1 Citation, commencement, interpretation and application

(1) This Order may be cited as the Community Care Plans (Disapplication) (England) Order 2003 and shall come into force on the day after the day on which it is made.

(2) In this Order—

“ the Act ” means the National Health Service and Community Care Act 1990; and

“local authority” has the same meaning as in section 46(3) of the Act.

(3) This Order applies to local authorities whose areas are situated in England only.

Section 2 Disapplication

The following provisions shall not apply to local authorities to which this Order applies—

(a) subsections (1) and (2) of section 46 of the Act; and

(b) the entry relating to section 46 of the Act contained in Schedule 1 to the Local Authority Social Services Act 1970 .
