The Nationality, Immigration and Asylum Act 2002 (Commencement No. 6) Order 2003

Section 1

(1) This Order may be cited as the Nationality, Immigration and Asylum Act 2002 (Commencement No. 6) Order 2003.

(2) In this Order—

“the 1981 Act ” means the British Nationality Act 1981 ;

“the 2002 Act ” means the Nationality, Immigration and Asylum Act 2002; and

“application” means an application for registration or naturalisation under any provision of the 1981 Act.

Section 2

The following provisions of the Nationality, Immigration and Asylum Act 2002 shall come into force on 1st January 2004:

(a) section 3 and Schedule 1; and

(b) section 14.

Section 3

The provisions commenced by this Order shall not have effect in relation to any application made before 1st January 2004; and any provision of the 1981 Act which is replaced or amended by those provisions, and any subordinate legislation which applies to such a provision of the 1981 Act, shall continue to have effect in relation to such an application as if the replacement or amendment had not been made.

Section 4

Section 50(8) of the 1981 Act (which makes provision for the date on which an application is made for the purposes of the Act) applies for the purposes of article 3 as it applies for the purposes of that Act.
