Section 1 Citation, commencement and extent

(1) This Order may be cited as the Education (School Lunches) (Prescribed Requirements) (England) Order 2003 and shall come into force on 6 th April 2003.

(2) This Order applies in relation to England.

Section 2 Interpretation

In this Order –

“lunch period” means the period between the morning and afternoon sessions on a school day;

“nursery education” means full-time or part-time education suitable for children who have not attained compulsory school age; and

“the 1996 Act ” means the Education Act 1996.

Section 3 Prescribed requirements for school lunches

(1) The following requirements are prescribed for the purpose of section 512(3)(a) of the 1996 Act.

(2) A registered pupil who is receiving nursery education must be receiving full-time education or must be receiving education both before and after the lunch period.
