The Health Act 1999 (Consequential Amendments) (Nursing and Midwifery) Order 2004

Section 1Citation and commencement

(1) This Order may be cited as the Health Act 1999 (Consequential Amendments) (Nursing and Midwifery) Order 2004 and shall come into force on 1st August 2004.

(2) The amendment to the Interpretation Act in paragraph 7 will come into force immediately after the coming into force of paragraph 7 of Schedule 5 to the Nursing and Midwifery Order.

Section 2Extent

The extent of any amendment of any enactment or instrument in the Schedule to this Order is the same as that of the enactment or instrument amended.

Section 3Consequential amendments

The enactments specified in the Schedule to this Order are amended as there specified.

Section 1National Health Service Reform and Health Care Professions Act 2002

In section 29 of the National Health Service Reform and Health Care Professions Act 2002 (reference of disciplinary cases by Council to court)—

(a) in subsection (1)(i), for “, midwife or health visitor” substitute “or midwife under the Nursing and Midwifery Order 2001” ;

(b) in subsection (2)(b), for “, midwife or health visitor” substitute “or midwife under the Nursing and Midwifery Order 2001”.

Section 2Care Standards Act 2000

In the Care Standards Act 2000 —

(a) in section 4 (other basic definitions), in subsection (5), for “, registered midwives or registered health visitors”, substitute “or registered midwives”;

(b) in Schedule 2A (persons subject to review by the Commissioner under section 72B), omit paragraph 24.

Section 3Employment Rights Act 1996

In section 55 of the Employment Rights Act 1996 (right to time off for ante-natal care), after subsection (4), add—

(5) References in this section to a registered nurse are to such a nurse—

(a) who is also registered in the Specialist Community Public Health Nurses' Part of the register maintained under article 5 of the Nursing and Midwifery Order 2001, and

(b) whose entry in that Part of the register is annotated to show that he holds a qualification in health visiting.

Section 4Children Act 1989

In the Children Act 1989 —

(a) in section 45 (duration of emergency protection orders and other supplemental provisions), after subsection (12), add—

(13) The reference in subsection (12) to a registered midwife is to such a midwife who is also registered in the Specialist Community Public Health Nurses' Part of the register maintained under article 5 of the Nursing and Midwifery Order 2001.

(b) in section 48 (powers to assist in discovery of children who may be in need of emergency protection), after subsection (11), insert—

(11A) The reference in subsection (11) to a registered midwife is to such a midwife who is also registered in the Specialist Community Public Health Nurses' Part of the register maintained under article 5 of the Nursing and Midwifery Order 2001.

(c) in section 102 (power of constable to assist in exercise of certain powers to search for children), after subsection (3), insert—

(3A) The reference in subsection (3) to a registered midwife is to such a midwife who is also registered in the Specialist Community Public Health Nurses' Part of the register maintained under article 5 of the Nursing and Midwifery Order 2001.

Section 5Police and Criminal Evidence (Northern Ireland) Order 1989

In Article 53(1) of the Police and Criminal Evidence (Northern Ireland) Order 1989 (interpretation of Part VI), in the definition of “registered health care professional”, for paragraph (a), substitute—

(a) a nurse registered in the Nurses' Part of the register maintained by the Nursing and Midwifery Council under article 5 of the Nursing and Midwifery Order 2001;

Section 6National Health Service (Scotland) Act 1978

In section 27 of the National Health Service (Scotland) Act 1978 (arrangements for provision of pharmaceutical services), in subsection (1A) —

(a) for paragraph (g), substitute—

(g) persons who are registered nurses or registered midwives;

(b) in paragraph (h), after “persons” insert “not mentioned above”.

Section 7Interpretation Act 1978

In Schedule 1 to the Interpretation Act 1978 (words and expressions defined), in the definition of “registered” in relation to nurses and midwives, for “Nurses and Midwives Order 2001” substitute “Nursing and Midwifery Order 2001”.

Section 8National Health Service Act 1977

In section 41 of the National Health Service Act 1977 (arrangements for pharmaceutical services), in subsection (3)—

(a) for paragraph (g), substitute—

(g) persons who are registered nurses or registered midwives;

(b) in paragraph (h), after “persons” insert “not mentioned above”.

Section 9Race Relations Act 1976

In the Race Relations Act 1976 , in Part 2 of Schedule 1A (bodies and other persons added after commencement of general statutory duty), omit the entries for the English National Board for Nursing, Midwifery and Health Visiting and the Welsh National Board for Nursing, Midwifery and Health Visiting.

Section 10Medicines Act 1968

In the Medicines Act 1968 —

(a) in section 11 (exemptions for nurses and midwives), in subsection (1), omit “and qualified”; and

(b) in section 55 (exemptions for doctors, dentists, veterinary surgeons and veterinary practitioners), in subsection (2)(b), for “certified midwife (or, in relation to England and Wales, by a certified midwife or exempted midwife)”, substitute “registered midwife”.

Section 11European Parliamentary Elections (Northern Ireland) Regulations 2004

In the European Parliamentary Elections (Northern Ireland) Regulations 2004 , in Schedule 2 (absent voters), in Part 1 (applications), in paragraph 4(2)(b), omit the words “within the meaning of section 7(7) of the Nurses, Midwives and Health Visitors Act 1997”.

Section 12European Parliamentary Elections Regulations 2004

In the European Parliamentary Elections Regulations 2004 , in Schedule 2 (absent voting), in Part 2 (applications), for paragraph 16(2)(b),substitute—

(b) a registered nurse;

Section 13Community Health Councils Regulations 2004

In the Community Health Councils Regulations 2004 , in regulation 9 (disqualification for membership), for paragraph (1)(e)(v) substitute—

registered nurse or registered midwife,

Section 14Nurses Agencies (Wales) Regulations 2003

In the Nurses Agencies (Wales) Regulations 2003 , in regulation 2 (interpretation), in paragraph (1), for the definition of “nurse” (“nyrs”), substitute—

“nurse” (“nyrs”) means a registered nurse or registered midwife;

Section 15Medicines (Child Safety) Regulations 2003

In the Medicines (Child Safety) Regulations 2003 , in regulation 1 (citation, commencement and interpretation), in paragraph (2)—

(a) for the definition of “first level nurse” substitute—

“first level nurse” means a nurse registered in Sub-Part 1 of the Nurses' Part of the professional register;

(b) in the definition of “nurse prescriber”, in paragraph (a), after “nurse” insert “or registered midwife”;

(c) in the definition of “professional register”, for “pursuant to paragraph 10 of Schedule 2 to”, substitute “under article 5 of”;

Section 17The Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003

In the Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003 , in Schedule 4 (excepted professions, offices, employments and occupations), in Part I (professions) for paragraph 6 substitute—

(6) Nurse or midwife.

Section 18Council Tax (Discounts) (Scotland) Consolidation and Amendment Order 2003

In the Council Tax (Discounts) (Scotland) Consolidation and Amendment Order 2003 , in article 7 (student nurses), in paragraph (1) for “on any of Parts 1 to 8, 10 and 12 to 15 of the Register maintained under section 7 of the Nurses, Midwives and Health Visitors Act 1997”, substitute “in the Nurses' or Midwives' Part of the register maintained under article 5 of the Nursing and Midwifery Order 2001”.

Section 19Local Health Boards (Constitution, Membership and Procedures) (Wales) Regulations 2003

In the Local Health Boards (Constitution, Membership and Procedures) (Wales) Regulations 2003 —

(a) in regulation 3 (membership of Local Health Boards), in paragraph (3), for sub-paragraph (i) substitute “a nursing or midwifery member;”; and

(b) in Schedule 2 (eligibility requirements for members), in Part II (eligibility requirements for specific categories of member)—

(i) in paragraphs (9) and (12) for “Nurses and Midwives Council”, substitute “Nursing and Midwifery Council”,

(ii) for the heading to paragraph (12), substitute “Nursing and midwifery member”,

Section 20Nurses Agencies Regulations 2002

In the Nurses Agencies Regulations 2002 , in regulation 2 (interpretation), in paragraph (1), for the definition of “nurse”, substitute—

“nurse” means a registered nurse or registered midwife;

Section 21European Communities (Recognition of Professional Qualifications) (Second General System) Regulations 2002

In the European Communities (Recognition of Professional Qualifications) (Second General System) Regulations 2002 , in Schedule 2 (regulated professions), in Part 1 (professions regulated by law or public authority), in the column headed “Profession” for the words “Nurse admitted to” to “Part 7 - Second level nurse (Scotland and Northern Ireland)”, substitute “Nurse admitted to Sub-Part 2 of the Nurses' Part of the register”.

Section 22Scottish Parliament (Elections etc ) Order 2002

In the Scottish Parliament (Elections etc) Order 2002 , in Schedule 3 (absent voting), in paragraph 2 (additional requirements for applications on grounds of physical incapacity), for sub-paragraph (2)(b), substitute—

(b) a registered nurse; or

Section 23Private and Voluntary Health Care (Wales) Regulations 2002

In the Private and Voluntary Health Care (Wales) Regulations 2002 , in regulation 2 (interpretation), in paragraph (1), in the definition of “midwife” (“bydwraig”) for “section 14(1)(b) of the Nurses, Midwives and Health Visitors Act 1997”, substitute “article 42 of the Nursing and Midwifery Order 2001”.

Section 24Misuse of Drugs Regulations 2001

In the Misuse of Drugs Regulations 2001 —

(a) in regulation 2 (interpretation), in paragraph (1)—

(i) for the definition of “registered health visitor”, substitute at the appropriate alphabetical place—

“specialist community public health nurse” means a registered nurse or midwife who is also registered in the Specialist Community Public Health Nurses' Part of the professional register and against whose name in that Part of the register there is an annotation that she has a qualification in health visiting;

(ii) insert at the appropriate alphabetical place—

“professional register” means the register maintained by the Nursing and Midwifery Council under article 5 of the Nursing and Midwifery Order 2001;

(b) in regulation 6 (general authority to supply and possess), in paragraph (2), omit “an extended formulary nurse prescriber,”;

(c) in regulation 11 (exemption for midwives)—

(i) in paragraph (1), for “section 14(1)(b) of the Act of 1997”, substitute “article 42 of the Order ”,

(ii) in paragraph (3)—

(aa) omit the definition of “the Act of 1997”,

(bb) in the definition of “appropriate medical officer”, in sub-paragraph (b), for “section 15 of the Act of 1997”, substitute “article 43 of the Order”,

(cc) in the definition of “local supervising authority”, for “section 15(1) of the Act of 1997”, substitute “Schedule 4 of the Order ”, and

(dd) insert at the appropriate alphabetical place—

“the Order” means the Nursing and Midwifery Order 2001;

(d) in Schedule 8 (persons who may supply or administer a specified controlled drug under a patient group direction), in paragraph 1, omit sub-paragraph (b).

Section 25Private and Voluntary Health Care (England) Regulations 2001

In the Private and Voluntary Health Care (England) Regulations 2001 , in regulation 2 (interpretation) in the definition of “midwife” for “section 14(1)(b) of the Nurses, Midwives and Health Visitors Act 1997”, substitute “article 42 of the Nursing and Midwifery Order 2001”.

Section 26National Care Standards Commission (Registration) Regulations 2001

In the National Care Standards Commission (Registration) Regulations 2001 , in regulation 2 (interpretation), in paragraph (1), for the definition of “nurse” substitute—

“nurse” means a registered nurse or registered midwife;

Section 27Northern Ireland Assembly (Elections) Order 2001

In the Representation of the People (Northern Ireland) Regulations 2001 , in regulation 55 (additional requirements for applications in respect of a particular election), in paragraph (4)(b) and (6)(d), in head (ii) omit the words “within the meaning of section 7(7) of the Nurses, Midwives and Health Visitors Act 1997”.

Section 28General Social Care Council (Appointments and Procedure) Regulations 2001

In the General Social Care Council (Appointments and Procedure) Regulations 2001 in regulation 4 (disqualification for appointment), in paragraph (7), for sub-paragraph (b) , substitute—

(b) a registered nurse or registered midwife;

Section 29National Health Service (Charges for Drugs and Appliances) (Wales) Regulations 2001

In the National Health Service (Charges for Drugs and Appliances) (Wales) Regulations 2001 , in regulation 2 (interpretation)—

(a) in paragraph (1)—

(i) for the definition of “independent nurse prescriber” (“nyrs sy'n rhagnodi'n annibynnol”), substitute—

“independent nurse prescriber” (“nyrs sy'n rhagnodi'n annibynnol”) means a person—

who is registered in Sub-Part 1 of the Nurses' Part or in the Midwives' Part of the register maintained by the Nursing and Midwifery Council under the Nursing and Midwifery Order 2001, and—

(iii) in the definition of “supplementary prescriber” (“rhagnodydd atodol”), for sub-paragraph (a), substitute—

(a) Sub-Part 1 of the Nurses' Part or in the Midwives' Part of the register maintained by the Nursing and Midwifery Council under article 5 of the Nursing and Midwifery Order 2001;

Section 39Prescription Only Medicines (Human Use) Order 1997

In the Prescription Only Medicines (Human Use) Order 1997 —

(a) in article 1 (citation, commencement and interpretation), in paragraph (2)—

(i) for the definition of “district nurse/health visitor prescriber”, substitute—

“district nurse/health visitor prescriber” means a first level nurse, or a registered midwife, against whose name in the professional register there is an annotation that he is qualified to order drugs, medicines and appliances from the Nurse Prescriber’s Formulary for District Nurses and Health Visitors Appendix in the current edition of the British National Formulary

(ii) in the definition of “extended formulary nurse prescriber”, in sub-paragraph (a), after “nurse”, insert “or registered midwife”,

(iii) for the definition of “first level nurse” substitute—

“first level nurse” means a person registered in Sub-Part 1 of the Nurses' Part of the professional register;

(iv) in the definition of “professional register”, for “pursuant to paragraph 10 of Schedule 2 to”, substitute “under article 5 of”,

Section 40Welsh Language Schemes (Public Bodies) Order 1996

In the Welsh Language Schemes (Public Bodies) Order 1996 , in the Schedule (specified public bodies), omit the entries for—

(a) United Kingdom Central Council for Nursing, Midwifery and Health Visiting;

(b) Cyngor Canalog y Deyrnas Gyfunol dros Nyrsio, Bydwreigiaeth a Gwasanaethau Ymwelwyr lechyd;

(c) Welsh National Board for Nursing, Midwifery and Health Visiting; and

(d) Bwrdd Cenedlaethol Cymru dros Nyrsio, Bydwreigiaeth a Gwasanaethau Ymwelwyr lechyd.

Section 41Health Authorities (Membership and Procedure) Regulations 1996

In the Health Authorities (Membership and Procedure) Regulations 1996 , in regulation 2 (membership of Authorities), for paragraph (2)(d), substitute—

(d) registration in the register maintained by the Nursing and Midwifery Council under article 5 of the Nursing and Midwifery Order 2001; or

Section 42Family Health Services Appeal Authority Regulations 1995

In the Family Health Services Appeal Authority Regulations 1995 , regulation 7 (disqualification for appointment), in paragraph (1)(i), for head (v), substitute—

(1) A person is a student nurse on a particular day if, on that day, he is undertaking a course which would (if successfully completed) lead to first registration in the Nurses' Part or the Midwives' Part of the register maintained by the Nursing and Midwifery Council under article 5 of the Nursing and Midwifery Order 2001

In the European Communities (Recognition of Professional Qualifications) Regulations 1991 , in Schedule 1, in Part 1 (professions regulated by law or public authority), in the column headed “Profession”, for the words “Nurses admitted to:” to “of the register maintained by the Nursing and Midwifery Council”, substitute—

Nurses admitted to Sub-Part 1 of the Nurses' Part of the register maintained by the Nursing and Midwifery Council
