Section 1Citation, commencement, interpretation and extent

(1) This Order may be cited as the Iraq (United Nations Sanctions) (Overseas Territories) (Amendment) Order 2004 and shall come into force on 29th July 2004.

(2) In this Order, “the principal Order ” means the Iraq (United Nations Sanctions) (Overseas Territories) Order 2003 .

(3) This Order shall extend to the territories listed in Schedule 1 to the principal Order.

Section 2Amendment of article 4 of principal Order

In article 4 of the principal Order, the definition of “restricted goods” shall be replaced by the following definition:

“restricted goods” means the goods specified in Part I of Schedule 1 to the Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003 made under the Export Control Act 2002 ;

Section 3New article 10a of principal Order

After article 10 of the principal Order, there shall be added a new article 10a as follows:

Exception

(10a) The privileges and immunities provided in articles 9 and 10 shall not apply with respect to any legal proceedings, nor to any resulting final judgement, arising out of a contractual obligation entered into by Iraq after 30th June 2004.
