Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) (No. 2) Regulations 2004.

(2) These Regulations except regulation 5 shall come into force on 29th September 2004.

(3) Regulation 5 shall come into force on 24th January 2010.

(4) In these Regulations “the principal Regulations ” means the Motor Vehicles (EC Type Approval) Regulations 1998 .

Section 2 Preliminary

The principal Regulations shall be further amended as follows.

Section 3 Amendment to Regulation 3 (Interpretation)

In regulation 3(1) of the principal Regulations for the definition of “the Framework Directive” there shall be substituted the following—

“the Framework Directive” means Council Directive 70/156/ EEC as amended by amendments up to and including those effected by Commission Directive 2004/78/EC ;

Section 4 Amendments to Schedule 1 (Separate Directives)

(1) The Table in Schedule 1 to the principal Regulations shall be amended as follows.

(2) In item 36 (Heating Systems), for the entries in the second, third and fourth columns there shall be substituted the following—

(3) In item 39 (CO 2 emissions/fuel consumption), there shall be added in the third and fourth columns after the last entry—

(4) In item 47 (Speed limiters), there shall be added in the third and fourth columns after the last entry—

(5) After item 8 (Rear visibility), there shall be added the following item—

Section 5 Revocation

Item 8 (Rear visibility) in the Table in Schedule 1 to the principal Regulations is revoked and item 8A shall be renumbered item 8.
