Section 1

This Scheme may be cited as the M62 Motorway (Junction 21 Improvements and Connecting Road) Scheme 2004 and shall come into force on 31st December 2004.

Section 2

In this Scheme—

(1) all measurements of distance are measured along the route of the relevant highway;

(2)

(i) “connecting road” means a special road about 675 metres in length, starting about 725 metres further west than the existing one, which connects the eastbound carriageway of the Motorway with a new roundabout junction. The special road is indicated as a thick black line on the plan;

(ii) “the Motorway” means the M62 Motorway at Milnrow near Rochdale;

(iii) “the plan” means the plan numbered HA/16/OD/26 titled “The M62 Motorway (Junction 21 Improvements and Connecting Road) Scheme 2004” signed by authority of the Secretary of State for Transport and deposited at the DTLR , Records Management Branch, Ashdown House, Sedlescombe Rd North, St Leonards-on-Sea, East Sussex TN37 7GA; and

(iv) “the special road” means the connecting road.

Section 3

The Secretary of State is authorised to provide the special road for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.

Section 4

The centre line of the special road is indicated by a heavy black line on the plan.

Section 5

The special road shall become a trunk road on the date when this Scheme comes into force.
