Section 1Citation, commencement and application

(1) These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) (No. 2) Regulations 2005 and shall come into force on 16 th September 2005.

(2) These Regulations shall apply only in relation to England.

Section 2Interpretation

In these Regulations any reference to the “Principal Regulations” is a reference to the Education (School Performance Information) (England) Regulations 2001 .

Section 3Amendments to the Principal Regulations

The Principal Regulations shall be amended in accordance with regulations 4 to 11.

Section 4Amendments to the Principal Regulations

In regulation 7, insert the words “and the proprietor of every Academy” after the words “secondary school”.

Section 5Amendments to the Principal Regulations

For regulation 8 substitute the following regulation—

Provision of information about fourth key stage results to the Secretary of State

(8) The governing body of every maintained school and the proprietor of every non-maintained special school or independent school which has registered pupils who are at or near the end of the final year of the fourth key stage or who are aged 15 but are not at or near the end of the final year of the fourth key stage shall, within two weeks of receiving a written request from the Secretary of State, provide him with the information specified in Part 1 of Schedule 3.

Section 6Amendments to the Principal Regulations

After regulation 8, insert the following regulation—

Provision of information about the results of pupils aged 16, 17 and 18 to the Secretary of State

(8A) The governing body of every maintained school and the proprietor of every non-maintained special school or independent school which has registered pupils who are aged 16, 17 or 18 shall, within two weeks of receiving a written request from the Secretary of State, provide him with the information specified in Part 2 of Schedule 3.

Section 7Amendments to the Principal Regulations

In regulation 13—

(a) in the heading, for the words “local education authorities” substitute the words “the Secretary of State”;

(b) in paragraph (1), for the word “authority” substitute the words “Secretary of State”; and

(c) in paragraphs (1) and (4), for the words “the third Thursday in January in each reporting school year” substitute the words “receiving a written request from the Secretary of State”.

Section 8Amendments to the Principal Regulations

In Schedule 2—

(a) in paragraph 2(2)(i), for the word “of” (where it first occurs) substitute the word “on”;

(b) in paragraph 2(2)(iA), for the word “of” (where it first occurs) substitute the word “on”;

(c) omit “or” at the end of paragraph 2 (2) (iv);

(d) for the full stop at the end of paragraph 2 (2) (v) substitute a semi-colon and insert “or”;

(e) after paragraph 2(2)(v), insert the following—

(vi) whether an NC test result relates to a test taken prior to the final year of the second key stage and the school year in which it was taken.

(f) after paragraph 2, insert the following paragraph—

(2A)

(1) In respect of each registered pupil in the second key stage other than those referred to in paragraph 2, who has taken one or two NC tests early, the pupil’s gender, date of birth and surname followed by first name or, if more than one, each first name and the date of registration at the school.

(2) In respect of each such pupil, the level on the National Curriculum level scale achieved by the pupil as determined by the results of the NC tests taken early.

Section 9Amendments to the Principal Regulations

In Schedule 2A—

(a) in paragraph 2(2)(i), for the word “of” (where it first occurs) substitute the word “on”;

(b) in paragraph 2(2)(ii), for the word “of” (where it first occurs) substitute the word “on”;

(c) omit “or” at the end of paragraph 2 (2) (v);

(d) for the full-stop at the end of paragraph 2 (2) (vi) substitute a semi-colon and insert “or”;

(e) after paragraph 2(2)(vi), insert the following—

(vii) whether an NC test result relates to a test taken prior to the final year of the third key stage and the school year in which it was taken.

(f) after paragraph 2, insert the following paragraph—

(2A)

(1) In respect of each registered pupil in the third key stage other than those referred to in paragraph 2, who has taken one or two NC tests early, the pupil’s gender, date of birth and surname followed by first name or, if more than one, each first name and the date of registration at the school.

(2) In respect of each such pupil, the level on the National Curriculum level scale achieved by the pupil as determined by the results of the NC tests taken early.

Section 10Amendments to the Principal Regulations

In Schedule 3—

(a) in the heading to the Schedule, for the words “Examination and Vocational Qualification Results” substitute the words “Fourth Key Stage Results and Results of Pupils aged 16, 17 and 18”;

(b) for the heading to Part 1 of the Schedule, substitute the following heading—

Pupils in the fourth key stage;

(c) for paragraph 1 substitute the following paragraph—

(1)

(1) The number of registered pupils who are at or near the end of the final year of the fourth key stage.

(2) The number of registered pupils aged 15 who are not at or near the end of the final year of the fourth key stage.

(d) omit paragraph 2;

(e) omit “and” at the end of paragraph 3 (2)(a);

(f) in paragraph 3(2), for paragraph (b) substitute the following paragraph—

(b) the external qualification taken and the grade or, where applicable, the level achieved;

(g) at the end of paragraph 3(2)(b), for the full-stop substitute a semi-colon and insert the following paragraphs—

(c) the school year in which he was entered for the external qualification and the name of the awarding body for that qualification;

(d) except where the pupil is registered at an independent school other than an Academy or CTC, the level on the National Curriculum level scale achieved by the pupil in the third key stage as determined by the results of NC tests in any of the school years preceding the reporting school year; and

(e) except where the pupil is registered at an independent school other than an Academy or CTC, the level on the National Curriculum level scale achieved by the pupil in the second key stage as determined by the results of NC tests in any of the school years preceding the reporting school year.

(h) omit paragraphs 4 and 5;

(i) after paragraph 7 in Part 2 of the Schedule, insert the following paragraph—

(1) The number of registered pupils aged 16, 17 or 18 who, during the reporting school year or any of the school years preceding that year, were entered for an external qualification approved under section 98 of the Learning and Skills Act 2000 for use by pupils who are over compulsory school age but have not attained the age of 19.

(2) In the case of each such pupil referred to in sub-paragraph (1), the following information—

(a) the pupil’s gender, date of birth and surname followed by first name or, if more than one, each first name;

(b) the external qualification taken and the grade or, where applicable, the level achieved;

(c) the school year in which he was entered for the external qualification and the awarding body for that qualification.

(j) omit paragraphs 9 and 10.

Section 11Amendments to the Principal Regulations

In the heading to Schedule 10, for the words “Local Education Authorities” substitute the words “the Secretary of State”.
