The Immigration (Eligibility for Assistance) (Scotland and Northern Ireland) (Revocation) Regulations 2005

Section 1 Citation, interpretation and extent

(1) These Regulations may be cited as the Immigration (Eligibility for Assistance) (Scotland and Northern Ireland) (Revocation) Regulations 2005.

(2) In these Regulations, “the 2000 Regulations ” means the Immigration (Eligibility for Assistance) (Scotland and Northern Ireland) Regulations 2000 .

(3) These Regulations extend to Scotland and Northern Ireland only.

Section 2 Commencement

(1) Regulation 3 shall come into force on—

(a) 5th October 2005 in the case of a person who is provided with social assistance under sections 7 and 8 of the Mental Health (Scotland) Act 1984 ;

(b) 12th December 2005in the case of–

(i) a person who is provided with social assistance under sections 12, 13A and 13B of the Social Work (Scotland) Act 1968 ; or

(ii) a person or family who or which is provided with assistance under section 22 of the Children (Scotland) Act 1995 (local authority support in Scotland for children and their families) ; or

(c) 3rd October 2005in the case of–

(i) a person who is provided with services under Articles 7 and 15 of the Health and Personal Social Services (Northern Ireland) Order 1972 ; or

(ii) a person or family who or which is provided with assistance under Article 18 of the Children (Northern Ireland) Order 1995 (equivalent provision in Northern Ireland) .

(2) Regulation 4 shall come into force on 12th December 2005.

Section 3 Eligibility for social assistance and eligibility for support for children-Scotland and Northern Ireland: Revocation

Regulations 2, 3, 4 and 5 of the 2000 Regulations are hereby revoked.

Section 4 Regulation 1 of the 2000 Regulations: Revocation

Regulation 1 of the 2000 Regulations (citation, commencement, interpretation and extent) is hereby revoked.
