Section 1

(1) These Regulations may be cited as the Costs in Criminal Cases (General) (Amendment) Regulations 2005 and shall come into force on 3rd October 2005.

(2) In these Regulations “ the Regulations ” means the Costs in Criminal Cases (General) Regulations 1986 and any reference to a regulation by number alone means the regulation so numbered in the Regulations.

Section 2

These Regulations shall apply in relation to an appeal under regulation 11(3) or (5) of the Regulations instituted on or after 3rd October 2005, and in relation to an appeal instituted before that date the Regulations shall apply as if these Regulations had not been made.

Section 3

In regulation 11(7), for “Part 8” substitute “Part 52”.

Section 4

In regulation 12(2), after “extend the time limit” insert “and shall consider whether it is reasonable in the circumstances to reduce the costs; provided that the costs shall not be reduced unless the representative has been allowed a reasonable opportunity to show cause orally or in writing why the costs should not be reduced”.
