Section 1 Citation, commencement and interpretation

(1) This Order may be cited as The Southwark London Borough Council (Prescribed Alteration) Order 2005 and shall come into force on 18 th November 2005.

(2) In this Order—

“the 1998 Act ” means the School Standards and Framework Act 1998 ;

“ the Regulations ” means the Education (School Organisation Proposals) Regulations 1999 ;

“the schools” means Walworth School , Waverley School , Kingsdale Secondary School and Aylwin Girls' School ; and

“the upper age limit” in relation to a school means the highest age of pupils for whom education is normally provided at the school.

Section 2 Exemption

The following provisions of the 1998 Act shall not, in respect of any alteration of the upper age limit at the schools, apply to the authority—

(a) section 28(1)(b); and

(b) section 33(1)(b).

Section 3 Time period

This Order shall have effect until 18 th November 2007.
