Section 1 Citation and commencement

These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) (No.3) Regulations 2005 and shall come into force on 12th December 2005.

Section 2 Modification of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations

After regulation 4, in Part II, of the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981 there shall be added—

Alternative prescribed conditions

(4A) The prescribed conditions as to the fitness of a vehicle contained in Part II may alternatively be met by a vehicle satisfying the requirements in such of the Annexes to Directive 2001/85/ EC of the European Parliament and of the Council of 20 November 2001, relating to special provisions for vehicles used for the carriage of passengers comprising more than eight seats in addition to the drivers seat, and amending Directives 70/156/ EEC and 97/27/EC , as apply to it.
