These Regulations may be cited as The Education (School Organisation Proposals) (Amendment) (No 2) (England) Regulations 2005 and shall come into force on 1st January 2006.

Section 2Amendment of the Education (School Organisation Proposals) (England) Regulations 1999
The Education (School Organisation Proposals) (England) Regulations 1999 shall be further amended as follows.
Section 3Amendment of the Education (School Organisation Proposals) (England) Regulations 1999
In regulation 2 (Interpretation) in the definition of “excepted expansion”, after “paragraphs 1, 2,”, insert—
(3) (but in respect of a prescribed alteration falling within paragraph 3, only where the alteration of the upper age limit is being made so as to provide sixth form education)
and for “or 12” substitute “, 12 or 13”.
