The Medicines (Sale or Supply) (Miscellaneous Provisions) Amendment Regulations 2005

Section 1 Citation, commencement and interpretation

(1) These Regulations may be cited as the Medicines (Sale or Supply) (Miscellaneous Provisions) Amendment Regulations 2005 and shall come into force on 7 th April 2005.

(2) In these Regulations, “the principal Regulations ” means the Medicines (Sale or Supply) (Miscellaneous Provisions) Regulations 1980 .

Section 2 Amendment of regulation 1 of the principal Regulations

In regulation 1 of the principal Regulations (citation, commencement and interpretation), in paragraph (2), in sub-paragraph (a)—

(a) in the definition of “relevant register” —

(i) in paragraph (a), omit “and”;

(ii) in paragraph (b), after “the Pharmacy (Northern Ireland) Order 1976 ;” insert “and”; and

(iii) after paragraph (b), insert—

(c) in relation to a person whose name is registered in the part of the register maintained by the Health Professions Council in pursuance of article 5 of the Health Professions Order 2001 relating to—

(i) chiropodists and podiatrists;

(ii) physiotherapists; or

(iii) radiographers: diagnostic or therapeutic,

that register

(b) in the definition of “supplementary prescriber” —

(i) in paragraph (b), omit “or”;

(ii) in paragraph (c), after “a registered midwife;”, insert “or”;

(iii) after paragraph (c), insert—

(d) a person whose name is registered in the part of the register maintained by the Health Professions Council in pursuance of article 5 of the Health Professions Order 2001 relating to—

(i) chiropodists and podiatrist;

(ii) physiotherapists; or

(iii) radiographers: diagnostic or therapeutic, or,

(iv) after “an annotation” insert “or entry”.

Section 3 Amendment of regulation 5 of the principal Regulations

In regulation 5 of the principal Regulations (restrictions on persons to be supplied with certain medicinal products), in paragraph (2), in sub-paragraph (c), omit “eye ointment containing Oxyphenbutazone and”; “Framycetin sulphate”, and “Thymoxamine hydrochloride”.

Section 4 Amendment of regulation 8 of the principal Regulations

In regulation 8 of the principal Regulations (pack size on retail sale or supply of certain medicinal products on a general sale list), in paragraph (2A) , for “20 tablets” substitute “50 tablets”.
