Section 1 Citation commencement and interpretation

(1) This Order may be cited as the Closures Guidance (Railway Services in Scotland and England) Order 2006 and shall come into force on 1st December 2006.

(2) In this Order, “ the Act ” means the Railways Act 2005.

Section 2 Closure guidance

(1) The closures guidance dated 18th October 2006 and laid before Parliament and the Scottish Parliament on 24th October 2006 is to have effect in relation to the proposals specified in paragraph (2).

(2) The proposals are as follows—

(a) the proposals referred to in section 42(1) of the Act; and

(b) the proposals referred to in section 42(2) of the Act, in so far as they relate to proposals to discontinue any cross-border services in relation to which—

(i) the Secretary of State provides funding; or

(ii) both the Scottish Ministers and the Secretary of State provide funding.
