Section 1 Citation and interpretation

(1) This Order may be cited as the Health Act 2006 (Commencement No.2) Order 2006.

(2) In this Order—

“the 1977 Act ” means the National Health Service Act 1977 ; and

“the 2006 Act ” means the Health Act 2006.

Section 2 Appointed day for provisions relating to the supervision and management of controlled drugs

(1) 1st January 2007 is the appointed day for the coming into force of Chapter 1 of Part 3 of the 2006 Act as it applies in relation to England, in so far as it is not already in force .

(2) 1st March 2007 is the appointed day for the coming into force of Chapter 1 of Part 3 of the 2006 Act as it applies in relation to Scotland, in so far as it is not already in force.

Section 3 Appointed day for provisions relating to applications to provide pharmaceutical services

28th February 2007 is the appointed day for the coming into force of—

(a) section 34 of the 2006 Act, except in so far as it relates to the Assembly’s functions under section 42B of the 1977 Act; and

(b) section 35 of the 2006 Act, except in so far as it relates to the Assembly’s functions under section 42 of the 1977 Act but otherwise in so far as it is not already in force .

Section 4 Appointed day for provisions relating to NHS costs recovery

29th January 2007 is the appointed day for the coming into force, except in so far as it extends to Scotland, of section 73 of the Act in so far as it is not already in force .
