Section 1 Citation and commencement

This Order may be cited as the Blackburn with Darwen (Maintained Nursery School Governance) (Amendment) Order 2007 and comes into force on 30th March 2007.

Section 2 Amendment

Article 3 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004 is amended as follows:

(a) for Article 3(b) substitute:

(b) sections 7(b) and 13(2) of the Education Act 2005 as if after the words “in the case of a maintained school” the words “other than a maintained nursery school” were added.

(b) after Article 3(d) insert a new sub-paragraph:

(dd) On and after the date section 88 of the Education and Inspections Act 2006 comes into force, section 88(5) of that Act ( responsibility of governing body for discipline ) as if paragraph (c) of that subsection were omitted.

(c) omit Article 3(l) and (m).

Section 3 Amendment

In Article 5 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004, for “30th March 2007” substitute “30th March 2009”.
