Section 1 Citation and interpretation

(1) This Order may be cited as the Education and Inspections Act 2006 (Commencement No. 7 and Transitional Provisions) Order 2008.

(2) In this Order—

“ the Act ” means the Education and Inspections Act 2006; and

“ SSFA 1998 ” means the School Standards and Framework Act 1998 .

Section 2 Provisions coming into force on 1st September 2008

The following provisions of the Act come into force on 1st September 2008—

(a) section 37 in relation to England only,

(b) section 77(2) and Schedule 8 (in each case for all remaining purposes), and

(c) section 154.

Section 3 Transitional provisions and savings

Where immediately before 1st September 2008 a member of staff at a school to which section 60 of SSFA 1998 applies enjoyed any rights conferred by that section, that person shall continue to enjoy those rights as though section 37 of the Act was not in force until the member of staff ceases to be employed or engaged at the school.
