Section 1 Citation and commencement

This Order may be cited as the Non-Contentious Probate Fees (Amendment) Order 2008 and shall come into force on 26th November 2008.

Section 2 Amendment of the Non-Contentious Probate Fees Order 2004

The Non-Contentious Probate Fees Order 2004 is amended as follows.

Section 3 Amendment of the Non-Contentious Probate Fees Order 2004

In Schedule 1, in fee 10, in column 2, for “2004” substitute “2008”.

Section 4 Amendment of the Non-Contentious Probate Fees Order 2004

In sub-paragraph (a) of Schedule 1A, in the definition of “party”, for “the party” substitute “the individual”.

Section 5 Amendment of the Non-Contentious Probate Fees Order 2004

In sub-paragraph 3(3) of Schedule 1A —

(1) in paragraph (a), for “£279” substitute “£296”;

(2) in paragraph (b), for “£198” substitute “£228”; and

(3) in paragraph (c), for “£142” substitute “£150”.
