Section 1 Citation and interpretation

(1) This Order may be cited as the Health and Social Care Act 2008 (Commencement No. 11) Order 2009.

(2) In this Order, “ the Act ” means the Health and Social Care Act 2008.

Section 2 Appointed day for provisions relating to the membership of the Office of the Health Professions Adjudicator

28th September 2009 is the day appointed for the coming into force of the following provisions of the Act—

(a) section 98(3) in so far as it relates to the provisions of Schedule 6 specified in paragraph (c);

(b) section 127 in so far as it relates to the provisions of Schedule 10 specified in paragraph (d);

(c) paragraphs 4 to 10 of Schedule 6; and

(d) in Schedule 10—

(i) paragraph 4(b),

(ii) paragraph 5(b), and

(iii) paragraph 26(b).

Section 3 Appointed day for provision relating to direct payments

9th November 2009 is the day appointed for the coming into force of subsections (1) to (7) of section 146 of the Act (direct payments in lieu of provision of care services) in relation to England, in so far as they are not already in force .
