These Regulations may be cited as the School Organisation (Establishment and Discontinuance of Schools)(England)(Amendment) Regulations 2009 and come into force on 16th December 2009.

The School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007 are amended as follows.

In regulation 2 omit the definition of “ APA rating”.
Section 4Amendment of the School Organisation (Establishment and Discontinuance of Schools)(England) Regulations 2007
In regulation 9—
(a) in each of paragraphs (1), (2)(a) and (b) and (5) for “APA” substitute “performance”;
(b) after paragraph (6) insert—
(7) In this regulation “current performance rating” means the most recent rating awarded to the authority under section 138(3) of the Act.
