Section 1 Citation and commencement

These Regulations may be cited as the Civil Enforcement of Parking Contraventions (England) General (Amendment) Regulations 2009 and shall come into force on 31st March 2009.

Section 2 Revocation

The Civil Enforcement of Parking Contraventions (England) General (Amendment) Regulations 2008 are revoked.

Section 3 Preliminary

The Civil Enforcement of Parking Contraventions (England) General Regulations 2007 shall be amended as follows.

Section 4 Interpretation

In regulation 2, paragraph (1A) shall be omitted.

Section 5 Evidence of contravention

For regulation 6, there shall be substituted—

Evidence of contravention

(6) A penalty charge shall not be imposed except on the basis of—

(a) a record produced by an approved device; or

(b) information given by a civil enforcement officer as to conduct observed by that officer.
