Section 1 Citation and commencement

These Regulations may be cited as the Additional Statutory Paternity Pay (Weekly Rates) Regulations 2010 and come into force on 6th April 2010.

Section 2 Weekly rate of payment of additional statutory paternity pay

The weekly rate of payment of additional statutory paternity pay shall be the smaller of the following two amounts—

(a) £139.58 ;

(b) 90% of the normal weekly earnings of the person claiming additional statutory paternity pay, determined in accordance with regulations 31 and 32 of the Additional Statutory Paternity Pay (General) Regulations 2010 .

Section 3 Rounding of fractional amounts

Where any payment of additional statutory paternity pay is made on the basis of a calculation at—

(a) the weekly rate specified in regulation 2(b); or

(b) the daily rate of one-seventh of the weekly rate specified in regulation 2(a) or (b),

and that amount includes a fraction of a penny, the payment shall be rounded up to the nearest whole number of pence.
