Section 1 Citation and commencement

This Order may be cited as the Unfair Dismissal and Statement of Reasons for Dismissal (Variation of Qualifying Period) Order 2012 and comes into force on 6th April 2012.

Section 2 Qualifying period for right to written statement of reasons for dismissal

In section 92(3) of the Employment Rights Act 1996 for “one year” substitute “two years”.

Section 3 Qualifying period for right to claim unfair dismissal

In subsections (1) and (2) of section 108 of the Employment Rights Act 1996 for “one year” substitute “two years”.

Section 4 Transitional provision

Articles 2, 3 and 5 do not have effect in any case where the period of continuous employment begins before 6th April 2012.

Section 5 Revocation

The Unfair Dismissal and Statement of Reasons for Dismissal (Variation of Qualifying Period) Order 1999 is revoked.
