The Constitutional Reform and Governance Act 2010 (Commencement No. 8 and Saving Provision) Order 2013

Section 1 Citation and interpretation

(1) This Order may be cited as the Constitutional Reform and Governance Act 2010 (Commencement No. 8 and Saving Provision) Order 2013.

(2) In this Order—

(a) “ the Act ” means the Constitutional Reform and Governance Act 2010; and

(b) “the IPSA ” means the Independent Parliamentary Standards Authority.

Section 2 Commencement

1st November 2013 is the day appointed for the coming into force of the following provisions of the Act—

(a) section 40 (Parliamentary and other pensions) so far as it is not already in force;

(b) in Schedule 6 (Parliamentary and other pensions)—

(i) paragraph 35(3);

(ii) paragraphs 38 to 41; and

(iii) paragraph 47(2) so far as it is not already in force.

Section 3 Saving

(1) The European Parliamentary (United Kingdom Representatives) Pensions (Consolidation and Amendment) Order 1994 and the European Parliamentary (United Kingdom Representatives) Pensions (Additional Voluntary Contributions Scheme) (No.2) Order 1995 (“the Schemes”) have effect as if they were schemes made by the IPSA under section 4 of the European Parliament (Pay and Pensions) Act 1979 .

(2) References in the Schemes to the Leader of the House of Commons are, from 1st November 2013, to be construed as references to the IPSA.
