Section 1 Citation

(1) This Order may be cited as the Apprenticeships, Skills, Children and Learning Act 2009 (Commencement No. 6) Order 2013.

(2) In this Order—

“ the Act ” means the Apprenticeships, Skills, Children and Learning Act 2009; and

“ Ofqual ” means the Office of Qualifications and Examinations Regulation.

Section 2 Provisions coming into force on 31st May 2013

The following provisions of the Act come into force on 31st May 2013—

(a) sections 145 and 146;

(b) section 266 to the extent that it relates to the provision in Schedule 16 specified below;

(c) Schedule 16 so far as it relates to the repeal of section 9 of the Education and Skills Act 2008 .

Section 3 Transitional provision

Any consultation carried out by Ofqual before 31st May 2013 for the purpose of developing criteria to be set under section 146(1) of the Act is to be treated as if it had been carried out by Ofqual under section 146(5) of the Act.
