Section 1 Citation and commencement

(1) This Order may be cited as the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England)(Amendment)(No. 2) Order 2014 and, subject to paragraph (2), comes into force on 1st September 2014.

(2) Article 3(a) comes into force on 1st August 2015.

Section 2 Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

The Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013 is amended as follows.

Section 3 Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

Article 2 is amended as follows—

(a) in paragraph (a) for the words “11th September 2013” substitute “16th July 2014”; and

(b) for paragraph (b) substitute—

(b) “the P Scale Document” means the document published by the Department for Education on 16th July 2014 entitled “Performance – P Scale – attainment targets for pupils with special educational needs who are working at a level set out in this Document in relation to a core or other foundation subject”.

Section 4 Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

After article 3(4) insert—

(5) In relation to any pupil who is in the first year of the fourth key stage on or after 1st August 2015 but before 1st August 2016, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics.

(6) In relation to any pupil who is in the fourth key stage on or after 1st August 2016, it is directed that the provisions relating to programmes of study set out in the Framework Document have effect for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics.

Section 5 Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

In article 5 for the words “P Level” substitute “P Scale” wherever they appear.

Section 6 Amendments to the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) Order 2013

For article 6(3) substitute—

(3) The Education (National Curriculum)(Attainment Targets and Programmes of Study in English in respect of the Third and Fourth Key Stages)(England) Order 2008 and the Education (National Curriculum)(Attainment Targets and Programmes of Study in Mathematics in respect of the Third and Fourth Key Stages)(England) Order 2008 continue to have effect in relation to any pupil who—

(a) is in the fourth key stage before 1st August 2015 for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics; or

(b) is in the final year of the fourth key stage on or after 1st August 2015 but before 1st August 2016 for the purposes of specifying the programme of study for the fourth key stage in relation to English and mathematics.

Section 7 Revocation of the Education (National Curriculum)(Attainment Targets and Programmes of Study)(England) (Amendment) Order 2014

The Education (National Curriculum)(Attainment Targets and Programmes of Study)(England)(Amendment) Order 2014 is revoked.
